[KHTS] – Two Ninja riders who suffered head injuries when the coaster derailed on Monday filed a lawsuit Six Flags Magic Mountain in Valencia.

Jeremy Ead and Olivia Feldman are seeking unspecified damages after suffering “direct trauma,” according to attorney Barry Novack.

ninjaride“They owe the highest degree of care to its passengers,” Novack said. “You don’t build it going through trees.”Novack questioned why Ninja, which opened more than 25 years ago, was built around the “wilderness,” referring to the trees that weave in and out of the approximately 2,700 foot long ride.

Ead and Feldman are seeking reimbursement of medical expenses, past and future; loss of earnings, past and future; and emotional distress. A dollar amount was not specified in the lawsuit.

A report by the California Department of Industrial Relations was expected to be released with an analysis of the crash.

Twenty-two passengers, including four who suffered injuries, had to be rescued by firefighters over the course of about two hours on Monday as they dangled about 40 feet above ground.

“The safety of our guests and employees is our number one priority and as a precaution, the ride will remain closed until a thorough inspection of the area is complete,” park officials said in a statement following the derailment.

      Oh, and I guarantee you this will go away long before it goes to court…see, MM knows they are wrong and will be paying heavily to make this be forgotten quickly.

    • I live in SCV and I use to work at Magic… So yea I get on their coasters knowing something can go wrong! I get on any coaster knowing something can go wrong! Who doesn’t?!? This isn’t the first time one of Magics coasters messed up and hurt someone! These people should count their lucky stars that they made it out alive!

  22. Actually, if you’re injured you should contact an attorney immediately. They will get patients in quickly to treat their injuries after they have been to the ER. The sooner the treatment, the better it is for the patient.

    • Actually, there are ways to tell that a tree is unhealthy. If the park built the coaster around trees for theming purposes, it was also their responsibility to maintain the trees specifically in that area.

    • I have a friend who was working the ER that night and said the worst of the injuries was a tiny abrasion above someone’s eye and someone complaining of knee pain. After examining the knee the person walked out with an ace bandage.

    • Then it is sad that they are suing. When people file frivolous lawsuits it makes it so much more difficulty for people that have true injuries. My husband has a catastrophic work related brain injury, there is no question he was injured and we are still fighting after 11 years for compensation. He will never work again.

  46. Some people do suffer emotionally from traumatic experiences – especially when they think they are about to die. Ever hear of PTSD? It hits more than just military personnel.

    • What?!?!?!?! Think you need to go back and check the history of Magic Mountain. They have quite a few deaths, (many times over the # of deaths Disney has ever had in its entire history). One year a couple were on their honeymoon and the roller coaster car they were in suddenly opened up and dropped them several stories to their deaths. Please check your facts before making statements. Oh and searching the internet only shows those deaths since the internet came to be in existence, it doesn’t cover those before Six Flags bought MM or the first 10-15 in business.

    If you were to look at the number of times that coaster operates per day and how many people ride that coaster each day and multiply it for the year and so on, you will see that MM has a great reputation for their safety. Problem is, everyone looks at each “bad” incident rather that all the times nobody did get hurt. This will settle out of court, the attorney will get a nice percentage of the settlement and the injured will pay thier bills and laugh their way to the bank with whatever is left with their ace bandage tightly wrapped around their knee. As far as the tree, look up summer / sudden branch drop as well as “force majeure”…MM has probably hired an arborist to inspect the tree and will evaluate the tree for removal if needed.

  62. I’ve worked on several litigation cases with severe injuries suffered on the Ninja ride. The records are readily available to view at Superior Court, Chatsworth courthouse or via their online case search. I seem to recall Cal-OSHA records as well

  65. My son works there and was there when it happened, working at the ride next door. All the ride’s safety features worked exactly like they should have, otherwise that ride would have derailed completely! They should thank Magic Mountain for investing in making sure these rides are safe in case things like this happen!

    Yes, they are suing, and they should be. They had every right, as do all of us, to expect Six Flags to maintain its rides in a safe condition, and that includes making sure that trees near the rides are not so close that they can fall on the rides, or not diseased so that they topple over. Perhaps Six Flags will learn something from this.

    My family and I took a vacation and visited sixflags on May 20th of this year. My wife was hit and injured by a tree that fell on her not just a branch but a whole tree. She was was knocked out and pinned between the tree and the table she was sitting on, she broke two vertabres in her back, there was no wind it just toppled over. Sixflags is very resposible for these two incidents in the last few months. We are from El Paso, Texas
