[NLF, Sept. 29] – Newhall Land announced Tuesday that the California Second Appellate District has affirmed the Los Angeles County Board of Supervisors’ environmental review and approval of Mission Village, part of the company’s proposed Newhall Ranch community west of Interstate 5 in the Santa Clarita Valley.

A three-justice panel of the Second District Court of Appeal unanimously affirmed a June 2014 ruling by the Los Angeles Superior Court (Hon. John A. Torribio) that upheld the Mission Village Environmental Impact Report (EIR), and other land use permits, which were originally approved by the County of Los Angeles in spring 2012. The Appellate Court acted on a lawsuit brought by plaintiffs — the California Native Plant Society, Center for Biological Diversity, Friends of the Santa Clara River, SCOPE, and other environmental groups.

Plaintiffs argued the Appellate County failed to sufficiently analyze the Project’s compliance with the County’s Development Monitoring System as it relates to water supplies and sewer capacity, but the Appellate Court rejected all such claims as without merit. Additionally, the Appellate Court rejected plaintiffs’ claims that the EIR failed to properly analyze sediment and beach replenishment issues.

Despite plaintiffs’ claims to the contrary, the Appellate Court also upheld the EIR’s analysis of impacts and mitigation to the slender mariposa lily, and to the project’s greenhouse gas emissions analysis.

Finally, the Court rejected plaintiffs’ claim that the EIR failed to analyze and mitigate copper runoff impacts on juvenile steelhead (trout).

In its 72-page opinion, the Court of Appeal rejected each argument presented by the plaintiffs, finding that the County had acted appropriately and with substantial evidence to approve the detailed EIR and related mitigation measures.

“As an owner of a company that is building master planned communities in California, we value our partnership with the County of Los Angeles,” said Emile Haddad, President and CEO of Five Point Communities, the development manager for Newhall Land. “Today, the County’s exhaustive environmental review was affirmed by the Court of Appeal to have been completed diligently and properly. We are thankful for the County’s efforts and look forward to implementing the plans for Mission Village.” “We also appreciate the Court’s diligence in carefully deciding each of the legal issues presented.”

Mission Village is located south of State Route 126 and includes a mix of residential, commercial, and non-residential uses, including 4,055 residential homes, 1.56 million square feet of mixed-use commercial space, an elementary school, a fire station, a public library, a bus transfer station, parks with a variety of sports fields and playgrounds, open space, natural habitat preserves and trails. It is part of Newhall Ranch’s Specific Plan, which has undergone over 15 years of environmental review by the County, state and federal agencies. At build out, the Newhall Ranch villages will bring tens of thousands of development-related and permanent jobs to the region. The Specific Plan also calls for over 11,000 acres of protected open space, 60 miles of trails, several public schools and community infrastructure, including a water recycling plant, fire stations, a public library and a sheriff station.

      That area is already way past the Palmdale/Lancaster area. There is still a lot of wide open spaces up here. But they could put in a solar or wind farm in place of these houses. That would not add to the traffic after they’re built, because they don’t generate long term jobs.

      Silly. 4000+ homes along the 126 aren’t going to contribute to the “overburdened” 5 freeway. That a bump on a frogs ass in terms of impact on traffic. The 5 freeway has been expanded and the 126 is under expansion right now.. Get a grip, progress is good.

    • The developer funded the expansion of the freeway for this very reason.

    • Get a clue kevin, anyone who travels the 5 freeway very often knows it is already over congested. Just look at the 5 north or south any time in the weekend, friday, any morning, or any evening commutes. That 1 lane expansion doesn’t really do much when it’s heavy traffic. Progress isn’t that great. We sure don’t need any more homes. Water? On yeah, that. We’re in a severe drought. Ah well, no one cares about that right.

      you do know that we are talking bout 4000 homes, not 400,000 right? All of California’s freeways are congested and it is all relative. For a Califonia freeway the 5 isn’t bad, your just whining. Have you ever driven on the 101? That’s congestion. Just remember that a large group fought the “expansion” and the developers that built your home. We can’t go back to onion fields and we need more housing.

        Actually this is just a small part of a mega development of TWENTY THOUSAND homes and yes the Chiquita Canyon Landfill is asking to get extended to 303 football fields laterally and an additional 12 stories vertically.         I believe the landfill is expecting its peak trucking cue of 50 foot trucks to be at the most 100 or so an hour. No biggie… That’s only about a mile long line of trucks. (Sarcasm font)

          Sort of … don’t know details about the elementary schools, but the high school and junior high don’t have to come online until the entire Newhall Ranch project is 80 PERCENT BUILT. That’s maybe 20 years and 16,000 homes from now.

  45. We have coyotes and other wild animals in our neighborhoods and backyards now like never before. The more land we take from these animals, the worse it’s going to get. We are causing them to lose their home which in turn becomes dangerous for our pets.

    Hey – did you see any comment from the other side on this? Notice how balanced our new media is – always tell the developer’s side and never the other side of the issues. This Court has never ruled for a conservation group in over 20 years. Are they going to rule against Newhall no matter what they do? You can bet NOT! So this decision was not unexpected. It is sort of like being in the Middle Ages. The wealthy land barrons control everything in the political system, so it is hard to get a fair review, even in the Courts. But the CA Supreme Court has taken up this Court’s last two rulings on Newhall Ranch, so there is hope they will take up this one too. In the meantime, if you got the Valencia Water Letter, and are not happy about adding all these units while you have to cut back, I urge you to email in a letter. If no one complains, all of this will just happen. Its not good enough to do it on facebook. You have to turn out at Council meetings and you have to vote.

      I think what I said was pretty straight forward. It’s just sad. I was born and raised here. My parents were raised here. My Grandparents help found Bouquet Baptist Church before they changed it after my Grandfather died. It’s just sad the rate of growth now, and all they care about is money.

I lived out here all my forty six years of life, and the streets and parking lots are overcrowded with sucky drivers in a hurry to get through a hundred lights in town!     They can claim to have “water rights,” but if he supposed water source has no water, what good does the “water right” do?

    The only reason for this development is PROFIT. And when profit comes up against the good of the people and the environment, it almost always wins.

    Once Newhall Land has built its giant development, it will move on to its next project. And leave all of us in the SCV with the consequences of what it has done forever.

    This is, after all “the American Way.”

  65. Awkward thought: CA is MILLIONS of dwellings short of the currrnt population need, falling further behind every single week. Infill redevelopment has a place, as does thoughtful new dwelling development. Proximity to jobs rules out much of the Central CA “open space”. The conundrum is where would NIMBYs rather put these folks? Garage apartments, illegal dwellings, substandard housing? Taxes & fees rule ot affordable housing, anyway. So, take s deep breath and be part of the solution, shall we? Bring ideas, not just complaints. End of Reality Check. Carry on.

    Definitely time to move. I’ve lived here since 1987 … the original Master Planned Community developed a city that was balanced in land use, resources, homes, businesses and schools with sufficient roads/access to control/minimize traffic gridlock. Over the last 10 years … led by Newhall Land/Lennar and aided & abetted by a career politician County Supervisor … the SCV has changed dramatically & for the worse: overpopulation, rampant annexation, constant traffic gridlock, poor air quality, school overcrowding, limited resources, wildlife habitat destruction … It’s a shame. ?

      The article indicated this was approved by the County so I’m guessing it would have been supported by whoever was the County Supervisor over this area of the County during that time period. Most of the County Supervisors are “career politicians”, by that I mean their only long term, full time, paid job has been in holding a position in public office. The recent passage of “term limits” by County voters will & has begun to change this … IMHO
