An 18-year-old man pleaded no contest for punching an elderly man who allegedly asked him to stop smoking at a park in Valencia, the Los Angeles County District Attorney’s Office said Tuesday.
Deputy District Attorney David Jacobs said Tanner Ian Smith of Saugus pleaded yesterday to battery on an elder in case 6SC01226.
Smith was immediately sentenced to 90 days in county jail, three years of summary probation, 30 days of community labor, 52 anger management classes and an order to stay away from the victim and Valencia Glen Park, where the incident took place.
On May 2, the 71-year-old victim asked a group smoking at the park to stop because of the young children playing there, the prosecutor said. The group laughed and insulted the victim who then took a photo of the activity, the prosecutor added.
Smith then punched the victim in the face, knocking him to the ground, according to the prosecutor.
The case was investigated by the Los Angeles County Sheriff’s Department, Santa Clarita Station.

We have the right to ask someone to not smoke near us, screw minding your own business….I am not a smoker and I don’t care that people smoke…but I should not have to inhale that. So…hopefully this punk will get his ass kicked…I would love to do it. How do you hit a 71 year old period??? Loser and a scumbag.
