nsd-logoWe are pleased to learn of the court’s decision today to rule in favor of the Newhall School District and declare us the prevailing party in our lawsuit against the Acton Agua Dulce Unified School District (AADUSD) and the Albert Einstein Academy for Letters, Arts and Sciences (AEALAS), finding that both parties failed to comply with state Education Code sections 47605 and 47605.1, and vacating the elementary charter granted to AEALAS extraterritorially in the Newhall School District jurisdiction. The judge recognized that both AADUSD and AEALAS are willfully violating the law and are holding them accountable for it.

We are relieved by the judge’s statement that the law never intended for school districts to utilize charter school approvals as a revenue generator, and that the approval of AEALAS was contrary to the spirit and letter of the state’s Charter Schools Act of 1992. In vacating the charter, the court gave AEALAS 120 days to seek and receive approval for a new charter application, directing them that a “rubber-stamped” application will be insufficient and must contain supporting research and documentation for the court to review, and that the application must meet the statutory requirements of the law.  He further directed that the approval must be based on the educational merit of the petition, and not AADUSD’s questionable revenue scheme.

This preliminary ruling also allows the Newhall School District to seek attorney fees, which we intend to do.

It is unfortunate that legal action was necessary, but we hope this will help effect positive change. In light of rampant disregard for the law by AADUSD and AEALAS, we were left with litigation as the only recourse. Governing board members took an oath of office to defend and uphold the law against violators. California’s 1992 Charter Schools Act, a law that is very specific in regards to the authorization, location and oversight of charter schools, especially as it concerns charter schools seeking a location outside the boundaries of their authorizing district, was utterly disregarded and the Newhall School District Governing Board took seriously its commitment to ensure the welfare and safety of the community and students residing within its boundaries.

We are thankful the court shares our commitment to ensuring schools and school districts are above reproach in their operations. If the AADUSD and AEALAS share that commitment, we hope this legal outcome will encourage them to seek ways to best serve students in a manner that does not abuse the system.

The children of our communities deserve the best education possible. We have a responsibility to ensure those opportunities are made available through proper, legal channels, and we hope to see this lawsuit conclude in a positive outcome.

  5. As a former student of this district, I am disappointed in NSD. They are so power hungry and financially motivated that the community comes 2nd.

    • How do you figure that? They are in violation of the law. None of the school districts in Santa Clarita wanted them.

    • The community wanted AEA and the community should have the final say. My child loves AEA and receives a superior education than the local districts provide. The boards should vote the way the community wants not the way they want. I attended the board meetings where they told AEA what needed to be fixed to gain approval, when the items were fixed they still would not approve them. The end result is AEA opened the kids love it and are learning new things everyday. They have friends and they have started to build a foundation that NSD would happily rip away from them. Hart district which I am proud to have been part of approved AEA as a charter school. Would it not make sense to have an elementary as well? The districts answer to the citizens not the other way around. Pardon any grammatical errors I wrote this from a tablet.

    • Just to add a final thought I have 3 children in elementary. My other two kids go to 1 of the top rated schools in Santa Clarita and as soon as this issue is resolved with the districts we plan on moving our other children to AEA as well. This is due to the quality we have seen from our 1st grader.

    • If our local district would fight this hard to provide good education for our kids we wouldn’t be having this problem ..

    • Charter schools operate very differently than regular public schools- they don’t receive the same amount of funds. Also charter schools don’t get the tax money out of your yearly taxes for site improvements that gies to your designated school site. But I’m 100% positive that a normal public school is also got a very active PTA trying to raise funds for the school trying to raise funds for new play quit trying to raise funds for new sports equipment and also teachers are asking for donations for all of the items inside the school so it really isn’t any different

      Debbie Banks Violin, you must be living in a fantasy bubble. The entire California public school system is doing this. It is not just happening to our local schools. Money is being spent on things at the administrative and district levels waistfully while the teachers and students go with out at the classroom level. NSD students are asked to do just as much fundraising to gather basic supplies as any other district. All I am saying is a lot of money is being spent on this battle, money that could be funding programs for the students.

    • Hmm I must be living in a fantasy bubble. But in this bubble my kids school has a great PE, music, and art program. We also manage to have an awesome playground and even got ourselves some great brand new buildings this year too. We all know there is a state budget problem. But somehow we still manage to be one of the best school districts around. Go figure!

    • A lot of money is also being spent on my gas in my car for the extra 10 minutes of traffic I have to sit in everyday trying to get past that damn school

    • Robyn Hodge…In NSD we have an art, orchestra and chorus program. We also have PE every Monday through Thursday for 30 minutes. In addition, we have teachers that love their students and are committed to putting in many hours above and beyond the “work day”. Drive by any school on a Friday afternoon at 4:30 pm and check out all the teacher’s cars in the parking lot. We even have current, up to date trainings, Smartboards and projectors to benefit the students and the teachers. Overall, NSD is an awesome district to work for!

    This is a huge disappointment. My grandchildren attend AEA and are the happiest they have been and flourishing more than EVER. These are kids who never clicked at other schools, always hates school. Now they wake up each morning say they LOVE school. How can you take this away from them? Their education is out of this world. My second grader sings in mandarin and my Kindergartener knows sign language and is learning Hebrew. The education is something no other school can touch. Shame on you NSD.

      Despite earlier reports by one of our local media outlets, today’s court ruling was a definite victory for the students, parents and teachers of Albert Einstein Academy.
      As a summary of today’s decision, the judge ruled that our authorizer, Acton-Agua Dulce Unified School District, made a procedural error by not having written findings of fact regarding Albert Einstein Academy locating outside the District boundaries. Thejudgeacknowledgedthereissufficientproofthatnoappropriate facilities exist within the District and opening our school outside the District was legitimate, but the District needs to validate this issue in writing.
      To resolve this matter, the judge ordered Acton-Agua Dulce Unified School District toapproveanewcharterforAlbertEinsteinAcademybyFebruary5,2015. Atthat time, the old charter will be set aside and the new charter will take effect.

  22. I’m very upset by this! Ugh! I had my kids on a waiting list to get in and then received the good news that they were in! But shortly after more news that the location was unknown and this not knowing what area my kids were going to be attending school bothered me! Was hoping to try again next year when things settled and they had all their problems solved! What’s the problem…anyone? Is there a lot more to this?

    NSD is so jealous of the success and great popularity of AEA that they just had to try to ruin them. Maybe putting money into the children’s programs, like Robyn Hodge said below would be a better solution and building the crappy NSD curriculum, better educating their teachers and staff would have been a better use of tax payer dollars! When my youngest child went to Pico Cyn Elementary they were a full year behind Mountain View Elementary School in their crappy curriculum and when she finally was able to transfer to her proper school (Stevenson Ranch), I had to spend thousands of dollars on tutoring to get her caught up to the rest of the class. Where’s my lawsuit? I didn’t pursue one because I tried to do the best for my child like all of the Parents who’s children are attending Einstein Academy! Look out for your children, and shame on NSD!

  33. This is not a NSD vs AEA issue. The teachers union and districts are all against charter schools, because charters threaten the public schools’ complacency. Many, but not all, public school teachers want to continue doing subpar work without the threat of being fired, yet still guaranteed a paycheck. Charter schools put those people out of a job AND eliminate the need for the union, which has devolved into an agency that is one degree away from the welfare system, where low work gets rewarded. My three children have tried multiple public and private schools in this provincial community or Awesometown, as it’s called, where bullying of the different child is not only tolerated, but also encouraged by administrators’ blind eyes and plugged ears. AEA is a gem! Teachers enjoy teaching. Teachers like all the children. That shouldn’t be novel. I pray that this Twinkie defense masquerade is unveiled as the hatred that it is.

    • I feel like you have skewed opinions on how hard most of the teachers in Santa Clarita work. Every teacher I have and do work with, interact with and who teach my children are amazing educators and go out of their ways to give my kids the best education possible. As for my working experience with them, I’ve learned more from them then I ever did in my years of formal education. I’m sorry you haven’t had the same experience, and yes, there are some “bad and lazy apples” out there (as there is in all fields, but Santa Clarita is one of the BEST educational ponds in Los Angeles. We should all count our blessings.

  35. If nsd is doing so great, why has the school ratings dropped every year since I moved here?? Why are there no programs like science lab, pe, orchestra, art, etc..Why is it worksheet after worksheet during class time?? Why are there no cafeteria workers serving real food for lunch that is made fresh?? Why do all the teachers look so unhappy and dont have that driven, happy to be a teacher attitude? It should be my right and my decision where and what type of education I seek for my children. We have put faith in our school district for years and every year, the school consistently drops in rating/scores! That is the proof. It is all about the mighty dollar. NSD wants the money of every resident bottom line. The school and the parents voice do not matter to them. My child is happy at AEA and hus teacher is actually kind and caring and you can tell she actually enjoys what she does. I hope that this is all going to pass and AEA prevails with great victory as it deserves!

    • The traffic caused by that particular location has been going on for ages. My husband attended preschool there. My MIL can vouch for how horrible the traffic was at that location going back over 30 years. It’s nothing new.

      Have lived in this neighborhood since 1992 we have one way in one way out , always a challenge at 800 am from Meadows Placerita Hart and COC but now it’s 300 pm with traffic back to McBean. Don’t care about the school one way or the other but when a Dad making a uturn flips my daughter off then I care! Just saying be considerate of your neighborhood

    • Very true Terri Ramsey. That’s awful. No one should be acting like that. One day I parked in the neighborhood to take my kids to school and some lady stopped to scream at me in front of my kids and scared the life out of them. I said not a word to her. 3 days later she actually tried, on purpose, to run my daughter, myself, another parent and her child over. So not cool. I get that the relationship between the neighborhood and traffic might not be on the best terms but, flipping people off and trying to run down kids is not the way to handle things.

    • Renee I am a product of the NSD. I have 3 children who have all attended the same NSD school as Debbie’s have. All 3 of my kids have had amazing success academically. 1 child is a college graduate, 1 is in college and one is on the Honor Roll in Jr. high. Maybe you do not think the NSD is doing a good job with the kids of the SCV, but as a former PTA president I assure you, you are wrong. There are laws in place for a reason. I suggest you check the test and aptitude scores. Public school isn’t for everyone, but the NSD and it’s teachers have an amazing track record.

  41. As a former classified employee of NSD in two schools and our son’s attended 2 of our schools I am saddened to see the negativity here regarding NSD. My boy’s are now both college graduates….one in a PhD program. They have had a great education in NSD and Hart districts. Like someone mentioned you will have some bad apples…but that’s with any career. The work ethic that the teachers have shown is exemplary. They love their jobs…..They do the best they can. They are continually training on new developments in the educator world. The Administration of the district and the schools is dedicated to ensuring a safe place for your students to learn. A place where your children are challenged and can grow academically. All of our district schools have PTA’s….but they are in no way equal in their fund raising efforts. Some due to demographics and some due to the way the economy is just to mention a couple. Education of your children begins at home. Working with them….helping them understand and sometimes asking the teachers for clarification. But overall I think we have a great district with dedicated teachers, employees and administrators. I have nothing wrong with a family decision to home school or go to private schools and probably AEA is also good…..just follow protocol and learn to work together. For peets sake it’s about the kids! Be grateful for what we have.

    • It is horrible of you to say someone’s kid isn’t “smart enough” to get in to a school. These are children. Not cannon fodder. And by the way – you get in to a charter school by lottery, not by how “smart” your kids are.

  51. NSD also provides art, chorus and orchestra. They have science and computer labs. I agree the lunch situation could be better…..but that’s pretty much a nationwide problem….simple solution folks pack them a healthy lunch. NSD also has a great special needs program. Sorry I just can’t say enough good things about my former employer….if I still lived in the area I would still be working for them.

  53. De Borah Alice, I don’t think anyone is jealous that their child isn’t at AEA. You don’t have to be “smart” to attend any school. All students have the right to attend school and there are many levels of students in any given grade level. By the way, isn’t is spelled “isn’t”, not inst.

    The district thinks they won! What pompous stupidity. How can you consider it winning when you are not able to provide an education anywhere equal to what the AEA children receive. The only losers in all of this are the kids who are afraid their school will be closed. NSD you should be embarrassed.

  55. I think someone asked me why I want to put my kids in AEA. Well, I have 6 kids and when my 1st and 2nd child were in elementary, class sizes were not as big as they are now that I have my 3rd and 4th child there. I feel like my kids, especially my 3rd grader is falling through the cracks. He’s very smart and seems very bored with school. Every teacher he’s had I haven’t particularly liked with how they handle things. From what I’ve heard about AEA, children thrive there. Children are free to learn how they need to learn. Public schools are cutting so much out now, kids are unable to use their creative abilities. They are like robots in school now. Teachers have no time for the kids either. There are just too many kids for one person to be able to teach and help each child one on one. My kids did get into AEA but I declined this year because they didn’t seem to have their location together this summer. I felt it was best for me to wait until there is a permanent location and then make the move. I think this should be about the type of education you want for your child…..not about money. We are all taxpayers here and I don’t see what the problem is other than people making it about money and not about a child’s education! As a community, we shouldn’t have to be in the middle of who gets what money! It’s a shame that so much energy is focused in the wrong direction!

  56. I really want my daughter to go to Albert Einstein Academy but am not willing to let her go all the way to agua dulce or acton for elementary. I will pay anything! Does anyone have any other recommendations?!

  57. I don’t think that very many of these students even belong to the Newhall School District, AEA School is just in the Newhall District. And they claim to provide the best education possible, I would like to see the two language’s that they teach on top of the amazing education they provide. I would like to back up public schools when they meet the same criteria as AEA. As for traffic which elementary, junior high or high school in any valley doesn’t have traffic, really!

If my kid wasnt able yo handle an advanced school then I would never look into it. My child definitely does hav enough time to grow up and enjoy his childhood. But were the only country that argues over what school goes where instead of lets make our kids smarter. If you never looked into AEA then do so. I went to public school in scv and was disappointed in it as a child… I swear my child is going to have better opportunities than I did. Stop… research… and educate yourself….

  59. This charter school is scrambling so much that the kids are the ones left suffering. They have ONE school counselor for THREE schools that traveled around. My 4 year old child was struggling and even though they knew it and agreed that she may have not been ready for full kindergarten, they also admitted that they were unable to do anything until she was assessed by the counselor. I was told: “We only have our school psychologist on a part time basis, usually one day per week. Legally, we must assess and service those kids where the law mandates us to do so first. After those kids are legally serviced, then we move in with others to get an initial assessment.” I have the emails to back it up!!! My poor kid had horrible self esteem issues last year due to her inability to keep up because this school was too busy spending money trying to get one over on the other district to focus on the MOST IMPORTANT thing – the children. We were given the run around for MONTHS over it. I knew within a month of school starting that something wasn’t right and brought my concerns to the teacher and then the principal. I was told over and over again that nothing could be done for her until she was assessed and that I wasn’t allowed to pull her until it was done.

    THE ONLY THING THEY HAD TO SAY TO ME WHEN I PULLED HER FROM SCHOOL was “I do apologize, and am sorry that you feel very disappointed.”

    Really?!?!

    Pull your kids before they get hosed too.

  60. Sounds to me nsd didn’t like competition. Forgive my ignorance but what exactly was the danger to our kids here?

    • NSD was not happy about lower enrollment which means less money for them. They used the public’s annoyance at the traffic situation to bolster their efforts to get AEA shut down.

  61. Problem is everyone on here is generalizing saying all of nsd is bad. Every school within the district is not failing, but some are. Some continue to drop in rating every year. If you love your school and see your child doing well there, then great. AEA is still a public school. Parents have more of a choice/hand in their child’s education in some regards. It just provides a family/child another outlet for an education and shouldnt concern anyone else. To say one is better off or more superior for attending AEA or another school whithin the NSD is pure ignorance and stupidity. At the end of the day, we are all just parents trying to make the best decisions for our children and that will look very different from child to child. I have children at both AEA and NSD and they are both flourishing and happy. Peace out!

  63. The end doesn’t justify the means. School representatives have the right and duty to act with integrity and values and NSD, AEA, and AADUSD all fell short with their process and approach in resolving this matter.

  66. I think this is terrible. Politics and money win out over educational choice for parents and kids. If NSD wants people to not seek other choices, change to accommodate them. I am sorry to all AEA parents. I wish that school was around when my son was in elementary. Please keep fighting the fight for educational reform.
