The Castaic Board of Trustees is looking to hire an attorney to help with the legal issues surrounding a home entrusted to Castaic Middle School.
The board will vote on the retainer agreement regarding a home on Church Street in Castaic that was given by Carol Jene Fielder to establish a scholarship fund with the money made from the homes sale, according to the board meeting agenda.
Andres Tapia was made responsible for the home and the grounds but problems arose in August when a notice of default was filed against the property, according to the attorney-client agreement between the Castaic District and Evelyn Leathers of Bezaire & Leathers.
Tapia has reportedly failed to pay rent, maintain the property and pay the mortgage on the home and has therein breached his duty as trustee, according to the documents.
If approved, the appointed attorney “will prepare, file and appear in court on litigation for the removal of Andres Tapia as trustee, designate a new trustee, cause the house to be distributed to the Castaic Middle School Trust.”
