[Sen. Pavley] – Gov. Jerry Brown signed a bill Saturday by Sen. Fran Pavley, D-Agoura Hills, that helps ensure victims of theft, fraud and abuse can collect financial restitution from offenders released into community supervision programs under the state’s realignment law.
“This bill protects crime victims’ constitutional right to collect the restitution they deserve and ensures that perpetrators of theft, fraud and abuse are not let off the hook,” Senator Pavley said.
Senate Bill 1197 closes a legal gap in California’s Realignment Act of 2011, under which some nonviolent, non-serious offenders who would have previously been released into state-supervised parole are now released into community supervision programs. The state constitution requires that offenders pay restitution anytime a crime victim suffers a loss, but counties currently lack clear authorization to collect restitution from this new class of offenders.
SB 1197 authorizes counties to collect court-ordered restitution from individuals who are supervised locally on behalf of victims of crimes such as identify theft, financial abuse of the elderly, mortgage fraud and other forms of consumer fraud. The bill also authorizes counties to collect restitution fines and restitution fees from offenders.
The bill is sponsored by the Los Angeles County District Attorney’s Office and supported by law enforcement organizations and Crime Victims United of California.
Pavley represents about half of the Santa Clarita Valley in the state Senate.
