shahram_hosseinian[KHTS] A 32-year-old Valencia man who was sentenced in late November for a sex crime was charged just two weeks later for the same charge.

Shahram Hosseinian was sentenced after pleading no contest on Nov. 30 to two days in county jail, probation for five years and was ordered to complete 30 days of community service for possessing child or youth pornography, said Ricardo Santiago, spokesman with the L.A. County District Attorney’s Office.

On Dec. 15, just two weeks later, Hosseinian was once again charged with possessing child or youth pornography, but this time it included the offense of having a previous conviction, said Santiago.

Hosseinian was arrested and his bail was set at $65,000.

Hosseinian, along with Elias Rojas-Dias, 45, of Sylmar, were arrested on July 31, 2015 on suspicion of sending or possessing obscene material, according to arrest records.

Rojas-Dias plead no contest on Sept. 1, 2015 to two counts of possession of matter depicting minor engaging in sexual conduct, or child pornography, said Ricardo Santiago, spokesman with the L.A. County District Attorney.

Hosseinian will appear in court on Jan. 27 for a preliminary setting, said Santiago.

    I hope they mean this.
    He was charged for stalking or touching a child then they found photographic material of children because in our constitution someone cannot be charged twice for the same crime unless new evidence is shown and only the new evidence can be used. I don’t want this man getting off for such a small flaw in the case such as double jeopardy. (That’s what it is called) let’s hope he gets put away

      Same charge does not mean same crime. Pretty sure “double jeopardy” implies someone can’t be charged for the same crime after being tried and convicted/acquitted of it.

      That’s what I meant Jose. He was already convicted of the crime so if they try him again for the same crime it won’t work unless new evidence or if it’s a different crime.

Why was he released in the first place…unbelievable they lock up people for 2 to 3 years for studied driving violation the they are release on 5 year probation yet they let people like him out lose in the community without a dog leash.
