He was charged for stalking or touching a child then they found photographic material of children because in our constitution someone cannot be charged twice for the same crime unless new evidence is shown and only the new evidence can be used. I don’t want this man getting off for such a small flaw in the case such as double jeopardy. (That’s what it is called) let’s hope he gets put away
Same charge does not mean same crime. Pretty sure “double jeopardy” implies someone can’t be charged for the same crime after being tried and convicted/acquitted of it.
That’s what I meant Jose. He was already convicted of the crime so if they try him again for the same crime it won’t work unless new evidence or if it’s a different crime.
