Attorney General Kamala Harris on Thursday issued a title and summary for a referendum that would overturn a new law making illegal alien college students eligible for financial aid.
The referendum by Orange County GOP Assemblyman Tim Donnelly would cancel AB 131 (Cedillo), which Gov. Jerry Brown signed into law Oct. 8.
Known as the second part of the California Dream Act, the bill makes undocumented students eligible for state-funded college aid after all eligible citizen students have applied for assistance.
Donnelly said the governor signed the bill “on the backs of every Californian who works hard and plays by the rules.”
Donnelly had publicly promised to file a referendum. Harris’ issuance of a title and summary clears it for signature gathering. If the referendum gathers enough signatures and is approved by voters, AB 131 would appear on a later ballot for an up or down vote by the people. In the meantime its effects would be suspended.
The official title is “Referendum to overturn state financial aid for undocumented students” and the summary reads as follows:
“If signed by the required number of registered voters and filed with the Secretary of State, this petition will place on the statewide ballot a challenge to a state law previously approved by the Legislature and governor. The law must then be approved by a majority of voters at the next statewide election to go into effect. The law would allow students who are undocumented immigrants and attended a California high school for three or more years, and graduated, to receive state financial aid to attend California universities and community colleges.”
