A 23-year-old woman was sentenced today to 13 years in state prison for kidnapping three children of her half-sister who was killed last year, the Los Angeles County District Attorney’s Office announced.
In July, Brittney Sue Humphrey pleaded no contest to three counts of kidnapping.
Deputy District Attorney Tal Kahana with the Child Abduction Section prosecuted the case.
Humphrey and her 28-year-old boyfriend, Joshua Robertson, allegedly kidnapped the three young children of Kimberly Harvill in August 2016. The three children were ages 5, 3 and 2 when the crime occurred.
The children were later found abandoned in New Mexico at a motel. Humphrey and Robertson were arrested later in Colorado.
Robertson and Alex Valdez, 29, have been charged with murdering Harvill, whose body was discovered in a remote area of Gorman. They also face a special circumstance allegation of lying in wait, making them eligible for the death penalty.
A decision on whether to seek the death penalty will be made at a later date.
Robertson also was charged with one count of possession of a firearm by a felon and two counts of an unrelated arson and one count of possession of flammable material.
Robertson is scheduled to return Sept. 25 for a preliminary hearing. Valdez is set for a pretrial hearing on Oct. 30.
Case BA449493 remains under investigation by the Los Angeles County Sheriff’s Department.

WTH!!! A person can kill someone and be out of jail in 7 1/2 years on good behavior! OMG! If it was a woman, she’d get worse especially if she had been abused for years. We need to change laws!!! He now gets free health care, hair cuts, weight room, meals…more than our homeless get for X amount of time.
I know its disgusting news, but one needs to finish reading the story, since the headline is easily misunderstood. The final paragraphs indicate the murder charge against her is still pending and she is eligible for the death penalty. A better headline might be:
“Child-napper pleads guilty, still faces death penalty for Murdering Sister”. It’s more factual and less titillating. But what do I know what sells?
So far it says the sister who wasn’t involved in the murder is getting 11 years the murderers have not been sentenced yet and can get the death penalty and hopefully will… I think her involvement should get her more time but at least the ones that actually killed her might end with the same fate.
