Democratic challenger Christy Smith’s lead has widened to 3,099 votes over Republican incumbent Dante Acosta in the race for California’s 38th District, according to the updated ballot count released Friday afternoon by the Los Angeles County and Ventura County registrars of voters.
Acosta conceded the race to Smith Wednesday as the count of provisional and mail-in ballots cast in the Nov. 6 general election continued (the 38th District includes areas of both LA and Ventura counties).
Following the registrars’ second update Tuesday, in which Smith pulled ahead in the overall count, Acosta called Smith to congratulate her and posted a concession note on his Facebook page.
In the updated tally released Friday afternoon, Smith leads by a total of 3,099 votes out of 165,321 ballots counted so far.
More than 600,000 ballots remain to be counted in LA County alone as of Friday’s update. Of those, roughly 4 percent should be from the 38th Assembly District.
The next updates from both county registrars are due Tuesday, Nov. 20, and Tuesdays and Fridays after that until all ballots are counted. The election results are not final until the count is complete and certified.
On Election Night, Acosta’s overall lead was 1,222 votes.
Friday’s tally showed Acosta’s lead slipping slightly in Ventura County compared to Tuesday’s count, as Smith widened her lead more dramatically in LA County, which has more 38th Assembly District voters than Ventura County.
Late absentee ballots are generally those mailed on election day or dropped off at polling places. Provisional ballots are cast at polling places on election day. The election-day ballots have been trending Democrat, compared to traditional “early” absentees, aka vote-by-mail ballots that were returned well ahead of election day, which trend Republican locally and are included in the initial vote tally.
