[KHTS] – Design defects of a Porsche sports car caused the crash that killed actor Paul Walker, the widow of the car’s driver said in a lawsuit against the automaker, alleging negligence and wrongful death, among other claims.

Kristine Rodas says in the lawsuit filed in Los Angeles Superior Court on Monday that a suspension failure of the 2005 Porsche Carrera GT led to her husband losing control of the vehicle before it careened into trees and a utility pole, killing Walker and driver Roger Rodas last November.

Walker’s death at age 40 led to a temporary halt in production of “Fast & Furious 7,” the successful movie series about illegal street racing that helped popularize his career.

Rodas’ attorney, citing expert inspections of the crash, says in the lawsuit that Roger Rodas, an experienced race car driver, was traveling at 55 miles per hour on Rye Canyon Road at the time of the crash, below the speed Los Angeles County Sheriff investigators said.

Authorities ruled the crash was caused by excessive speed and not a mechanical failure. The investigation found Rodas was traveling at speeds of 80 to 93 mph, which caused him to lose control of the car in a 45-mph zone.

The suit asks for unspecified damages from Porsche Cars North America, which is owned by Volkswagen AG.

“We’re very sorry for the Rodas and Walker families’ loss,” company spokesman Nick Twork said. “The crash was the subject of a detailed investigation of the proper authorities… and their investigation disproves the allegations in the lawsuit.”

  1. How can they sue!! They were going high speeds 80 + miles per hour in a 30 mile an hour turn! Crazy

  2. That’s so tragically stupid.

  3. Ahhaha the pedaso de mierda was speeding wtf

  4. Stephen Gold says:

And pencils don’t miss spell words… They were reckless…

  5. Kim Sloan says:

The operator of the vehicle was in control of the amount of speed, so her lawsuit is frivolous and a waste of time. The witness’ all saw the Porsche speeding losing control & crashing. Game over. Let these men live in peace. Enough.

  6. Next they’ll be suing the city over reckless tree planting. If the tree hadn’t been planted as part of the streetscaping, the two speeders wouldn’t have hit the said tree and perish.

  10. It’s always someone else’s fault. Hoe fast was the car going? They could have killed someone!

Right, it was the car’s fault. Just like it’s McDonalds’ fault that you have diabetes.

  14. Go figure….
MAYBE, his boxers were too tight…
    Loose nut behind the wheel?

I understand her grief and wanting to blame someone, but this is very disappointing to read. She’s lucky Paul Walker’s family isn’t suing her husband’s estate.

  18. She’s being used by Universal for Walker’s death. It rolls downhill

  19. Cars driver??? Don’t get me wrong I too was/still am a fan of Paul’s but, How about call the driver by his name… Roger Rodas. He was a SCV Resident and Business owner. Beside last I read the car wasn’t at fault for them driving at a high rate of speed.

  20. Mike Hider says:

    There was a short…..
Somewhere between the steering wheel & the drivers seat

  21. He was going 120mph on surface streets . How is this porches fault ?

  22. Greg Brown says:

45 mph! Enough Said. That is a tight right-hander.

  23. John Harris says:

The 2005 Porsche Carrara gt definitely has a design flaw.the car didnt have a psms (Porsche stability management system) which is now required by law.A psms is a computer that corrects the rear end of the car from spinning out of control.Porsche has been sued before for this flaw.

  24. John is correct. On the other hand, this wasn’t secret or unknown knowledge and when Roger got behind the wheel he was aware of it. The fact is that if he had been going the speed limit, 45mph and not 120mph, we wouldn’t be having this conversation.

  25. Ruben Pous says:

    90mph didn’t cause the crash ?

  26. What a POS she is. Now I hope the city sues her

  27. Joe Kensil says:

I’ve driven this road many times. 50 MPH would be excessive. Must have been the (Highly-modified) car’s fault..

  28. Thats normal, you sue for tripping on a tooth pick here !

  29. For God sake they were speeding ! They killed them selves ?

  30. Chris Brewer says:

Her attorney says they were going 55 mph. Pfft!!! I call serious bs. That is a nasty turn. I work at a shop on the outside of that corner. We can see the site from the front door. I hear tires squealing through it all day long. People just need to slow down. And I’m with everyone else, Porsche did not make him stomp that gas pedal in a 45 mph zone. I hope this gets thrown out.
