[KHTS] – Design defects of a Porsche sports car caused the crash that killed actor Paul Walker, the widow of the car’s driver said in a lawsuit against the automaker, alleging negligence and wrongful death, among other claims.

Kristine Rodas says in the lawsuit filed in Los Angeles Superior Court on Monday that a suspension failure of the 2005 Porsche Carrera GT led to her husband losing control of the vehicle before it careened into trees and a utility pole, killing Walker and driver Roger Rodas last November.

Walker’s death at age 40 led to a temporary halt in production of “Fast & Furious 7,” the successful movie series about illegal street racing that helped popularize his career.

Rodas’ attorney, citing expert inspections of the crash, says in the lawsuit that Roger Rodas, an experienced race car driver, was traveling at 55 miles per hour on Rye Canyon Road at the time of the crash, below the speed Los Angeles County Sheriff investigators said.

Authorities ruled the crash was caused by excessive speed and not a mechanical failure. The investigation found Rodas was traveling at speeds of 80 to 93 mph, which caused him to lose control of the car in a 45-mph zone.

The suit asks for unspecified damages from Porsche Cars North America, which is owned by Volkswagen AG.

“We’re very sorry for the Rodas and Walker families’ loss,” company spokesman Nick Twork said. “The crash was the subject of a detailed investigation of the proper authorities… and their investigation disproves the allegations in the lawsuit.”

    The operator of the vehicle was in control of the amount of speed, so her lawsuit is frivolous and a waste of time. The witness’ all saw the Porsche speeding losing control & crashing. Game over. Let these men live in peace. Enough.

  19. Cars driver??? Don’t get me wrong I too was/still am a fan of Paul’s but, How about call the driver by his name… Roger Rodas. He was a SCV Resident and Business owner. Beside last I read the car wasn’t at fault for them driving at a high rate of speed.

    The 2005 Porsche Carrara gt definitely has a design flaw.the car didnt have a psms (Porsche stability management system) which is now required by law.A psms is a computer that corrects the rear end of the car from spinning out of control.Porsche has been sued before for this flaw.

  24. John is correct. On the other hand, this wasn’t secret or unknown knowledge and when Roger got behind the wheel he was aware of it. The fact is that if he had been going the speed limit, 45mph and not 120mph, we wouldn’t be having this conversation.

    I’ve driven this road many times. 50 MPH would be excessive. Must have been the (Highly-modified) car’s fault..

    Her attorney says they were going 55 mph. Pfft!!! I call serious bs. That is a nasty turn. I work at a shop on the outside of that corner. We can see the site from the front door. I hear tires squealing through it all day long. People just need to slow down. And I’m with everyone else, Porsche did not make him stomp that gas pedal in a 45 mph zone. I hope this gets thrown out.
