Senator Sharon Runner, R-Antelope Valley, has announced her legislation to assist small business owners in dealing with California’s onerous state regulations passed the Senate Business, Professions and Economic Development Committee with unanimous, bipartisan support.
Senate Bill 1228 is modeled after the Federal Small Business Regulatory Enforcement Fairness Act, signed by President Bill Clinton in 1996.
“California is routinely ranked last among states in providing a business friendly environment and often times small business owners do not know they are out of compliance with California’s complex laws and regulations,” said Runner. “SB 1228 will direct state regulators to provide much needed assistance to small businesses who want to do the right thing.”
Specifically, SB 1228 would require each state agency to assist small businesses in compliance and enforcement of regulations and to adopt rules to allow for waivers or reductions of small business penalties under certain circumstances when the business acts in good faith and corrects any violation.
SB 1228 enjoyed the full support of the Senate Business, Professions and Economic Development Committee, including Senator Tom Berryhill (R-Twain Harte), a co-author of the measure.
“Our goal should be helping businesses get in compliance with regulations,” said Berryhill. “The system we have now focuses on punishment – not compliance. This bill would ensure that regulators still have the ability to punish bad actors, and at the same time, the discretion to help others comply.”

I applaud Mrs. Runner’s efforts. However, I am very leery of having the government assisting in ” helping businesses get in compliance with regulations”!! It’s like letting the Fox into the Hen House. Regulations are killing small business in California. I would prefer “helping the government understand that regulations are inhibiting business”. All we get from the government is take, take, take, audit, audit, audit.

It seems like every day CA is passing a new law that makes it that much harder for businesses to function. But those career politicians just keep going.
