Tip of the Week: Exposure to Legal Marijuana
Many people have expressed their concerns to me regarding the legalization of Marijuana in California, and how they and their children may be exposed to the second-hand smoke of Marijuana products. Basically, Marijuana will be treated the same as smoking tobacco and consuming alcohol.
Per 11362.3 H&S (Health and safety code), Marijuana may NOT be smoked in any public place where smoking is prohibited. This includes on or within 1,000 feet of a school, day care center, or youth center where children are present. This also includes in or around government buildings and city or county parks where smoking tobacco is prohibited.
Per 23152 CVC (California Vehicle Code), smoking or consuming Marijuana while operating any kind of motor vehicle, to include cars or trucks, boats, off road recreational vehicles, air craft, or any type of vehicle which accommodates transportation of a person, is prohibited and caries the same penalties as a DUI involving alcohol.
Per 11362.4(b) H&S, no person may smoke or ingest any Marijuana product while riding as a passenger in a motor vehicle, to include cars or trucks, boats, off road recreational vehicles, air craft, or any type of vehicle which accommodates transportation of a person.
Per 223222(a) CVC, no person may possess an open container or package of Marijuana or Marijuana product while driving, operating, or riding as a passenger in any kind of motor vehicle, to include cars or trucks, boats, off road recreational vehicles, air craft, or any type of vehicle which accommodates transportation of a person.
Hopefully with these laws in place, those of us who still chose not to use Marijuana products will have minimal exposure to the second-hand smoke, and those who do chose to smoke, will respect our rights to breath clean air.
Take care, and be safe.
